What signs can you not trademark?
What signs can you not trademark?
Generally, the two main considerations are:
•Is the trademark too descriptive?
Trademarks that are too descriptive may not be registrable. An example is ‘Golden Bread’ for bread.
•Is the trademark similar to an existing trademark?
If the trademark is the same as an existing trademark on the trademarks register, it may not be registrable, unless you can prove you were using the trademark before the filing date of the earlier trademark or show other circumstances.
The Trademarken trademark filing interface automatically searches across existing trademarks.
