What happens if you don't protect your brand with a trademark?
If you don't protect your trademark, others, including your competitors may decide to start using a trademark that may be deceptively similar to your trademark, effectively trading off your reputation.
Generally, without a trademark it is difficult to stop someone appropriating your reputation in this manner. Usually you will have to take them to court and rely on the common law defences which are generally difficult to establish and expensive to run.
What happens if you do protect your brand with a trademark?
There are a number of benefits to your registering your trademark.
Firstly, your trademark is available for inspection in the trademarks register. This means that others may be either dissuaded from filing the same or similar trademarks or prevented from registering a same or similar trademark during examination by the examiner.
